1. Agreement to Terms

Welcome to DecorAI. These Terms of Service ("Terms") are a legal agreement between you and Creefty LLC ("Company", "we", "us", or "our"), a company registered in the United States at 30 N Gould St, Ste R, Sheridan, WY 82801.

By accessing or using DecorAI at decorai.io ("Service"), you agree to be bound by these Terms. If you do not agree, you may not access or use our Service.

2. Description of Service

DecorAI is an AI-powered design platform that allows users to upload photos of spaces and generate photorealistic redesigns using artificial intelligence.

Our Service includes room redesign, exterior redesign, landscape redesign, virtual staging, video generation, and other AI design tools.

3. Eligibility

You must be at least 18 years old to use our Service. By using DecorAI, you represent and warrant that you meet this requirement.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration

To use DecorAI, you must create an account. You agree to:

Provide accurate and complete information during registration
Keep your account credentials secure and confidential
Notify us immediately at [email protected] if you suspect unauthorized access
Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Billing

DecorAI offers monthly, half-yearly and yearly subscription plans. Plan details, including AI credit allocations and features, are described on our pricing page.

New subscriptions are billed and processed securely through Stripe. Subscriptions that started through Paddle continue to be billed by Paddle.com, which is the Merchant of Record for those orders. DecorAI does not directly store your payment card information.

Subscriptions are billed on a recurring basis depending on your selected plan.

We reserve the right to change subscription prices with at least 30 days notice before changes take effect.

Unused AI credits roll over only if your active subscription remains equal to or higher than your previous plan tier.

6. Refund Policy

Refunds are governed by our Refund Policy, which is part of these Terms. If these Terms and the Refund Policy differ on refunds, trials or cancellations, the Refund Policy applies.

In short, we refund a first subscription payment only when you ask within 30 days of the charge, you used fewer than 5 image generations, and we confirm a clear technical issue on our side. Charges after a free trial converts to a paid plan are not refunded, unless no images were generated.

7. Image Designs and Video Credits

Image designs are unlimited on paid plans and do not use credits. AI videos use credits:

5 credits per home renovation video
10 credits per 24fps 720p video
20 credits per 60fps 1080p video

Credits refresh at the start of each billing cycle.

Failed generations caused by technical issues on our end will automatically restore consumed credits.

8. User Content and Uploaded Images

You retain ownership of all uploaded content and images.

Uploaded images are processed solely to generate AI design outputs and are not used to train AI models.

We store uploads and generated outputs to help users access past generations and receive support assistance when needed.

You may request deletion of your uploaded content at any time by contacting [email protected].

When the Public setting is on for a generation, your uploaded photo and the results may appear in the public DecorAI gallery. You can turn Public off for any generation.

You agree not to upload content that:

Infringes on third-party intellectual property rights
Contains nudity or explicit material
Depicts illegal activities or harmful content
Violates applicable laws or regulations

9. Generated Outputs and Commercial Usage

All AI-generated designs created through DecorAI include a commercial usage license with every subscription plan.

Generated outputs may be used for personal projects, client presentations, real estate listings, marketing materials, and commercial work.

Users retain rights to use designs generated during their active subscription period even after cancellation.

10. Prohibited Uses

You agree not to:

Use the Service for unlawful purposes
Reverse-engineer or extract underlying AI models
Scrape or automate access beyond normal use
Resell access to the Service itself
Generate prohibited or harmful content
Disrupt the integrity or security of the Service
Attempt unauthorized access to any system or account

11. Images of People

DecorAI is built for photos of rooms, buildings and outdoor spaces. We do not allow human face generation, face manipulation, deepfakes or face swapping, and we restrict the generation of human faces in our tools. Because some tools accept free-text prompts, a user may still be able to get around these restrictions. Doing so breaks these Terms, and we take action against any account that does it.

You agree not to use DecorAI to:

Generate, edit or swap the face, body or identity of a real person
Impersonate anyone or create misleading images of real people
Create sexual, nude or intimate images of anyone
Upload or create images of minors
Upload photos of other people without their permission

When we find content that breaks these rules, we remove it and may suspend or close the account without a refund.

12. Copyright and Takedown Requests

If you believe content on DecorAI infringes your copyright or other intellectual property, email [email protected] with the subject "Copyright notice" and include:

Your name and contact details
A description of the work you own
The URL or a screenshot of the content you are reporting
A statement that you believe in good faith the use is not authorized
A statement that your notice is accurate and that you are the owner or are authorized to act for the owner
Your physical or electronic signature

We acknowledge notices within 2 business days and remove or disable content that we confirm is infringing. If we remove your content and you believe it was a mistake, reply to our notice with a counter-notice explaining why.

13. Reporting Abuse

To report abusive, illegal or harmful content, including images of a real person made without their consent, email [email protected] with the subject "Abuse report", the URL or image, and the reason. You can also contact us through our support page.

We acknowledge reports within 2 business days, review the content, and act on confirmed reports, for example by removing the content and suspending the account.

You are responsible for the content you upload and create with DecorAI. If a user misuses the Service in breach of these Terms, that user is responsible for the misuse.

14. Repeat Violations

A first minor violation can lead to content removal and a warning. Serious violations, such as non-consensual intimate images, images of minors or impersonation of a real person, lead to immediate account termination.

We terminate the accounts of repeat infringers and repeat violators. Terminated accounts are not refunded, and the person may not open a new account.

15. Intellectual Property

DecorAI, its branding, software, designs, and related materials are the intellectual property of Creefty LLC.

Nothing in these Terms grants ownership or rights to our trademarks or intellectual property beyond the limited right to use the Service.

16. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind.

We do not guarantee uninterrupted service, perfect AI outputs, or suitability for any particular purpose.

AI-generated outputs are creative suggestions only and should not replace professional architectural, engineering, or construction advice.

17. Limitation of Liability

To the maximum extent permitted by law, Creefty LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

Our total liability shall not exceed the amount paid by you to DecorAI during the 12 months preceding the claim.

18. Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

You may cancel your subscription at any time through your account settings.

If you cancel, you keep access until the end of the current billing period. If we terminate your account for breaking these Terms, your right to use the Service ends immediately.

19. Changes to Terms

We reserve the right to modify these Terms at any time.

Updated Terms will be posted on our website with a revised effective date.

Continued use of the Service after updates constitutes acceptance of the revised Terms.

20. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States.

Any disputes arising under these Terms shall be resolved in the courts of Sheridan County, Wyoming.
